Gerash Steiner Blanton, P.C. is pleased to announce that our partner, Michael W. Blanton was part of a team that obtained a $56,575,000 verdict against Ford Motor Company in Colorado Springs Federal District Court on April 17, 2024.
The case involved a Ford 1998 Exhibition that had a defect in the shift control system. The defect involved an improper bushing and shift tube that caused looseness in the shift system which allowed the vehicle to be placed into false park (in between park and reverse) without the driver’s knowledge. Plaintiff got out of her car, slipped on ice beside the car, and the car then began moving backward in powered reverse and ran over her left leg.
Injuries to Plaintiff’s left leg were substantial. Doctors described it as degloving injury, in which the flesh and muscle are completely stripped away, leaving bare broken bone. Plaintiff’s bone and flesh have healed, but Plaintiff suffered severe nerve damage which has resulted in Complex Regional Pain Syndrome (CPRS). She has had multiple surgeries attempting to address the nerve pain, including insertion of a stimulator at her spine intended to interrupt the pain signaling, but to no avail. At this point doctors have told her that her only option is to have the leg amputated in the hope that this will at least partially relieve her pain (she may still suffer from phantom pain).
The evidence in the case presented a long history of knowledge on Ford’s part, including National Highway Traffic Safety Administration documents dating back to the 1980s which showed Ford’s general knowledge of the problem, and Technical Service Bulletins from the 1990s which showed more specific knowledge of the problem that Ford shared with its dealers but not with the public. The jury’s award included $45,000,000 in punitive damages.
