Since 1963, all Americans have enjoyed the right to a state-appointed attorney, regardless of the charges against them. The right to a public defender has become synonymous with arrests and Miranda Rights. But relying on a public defender probably isn’t your best option. In fact, we have some very good reasons why you can’t rely on an appointed attorney.
Denver saw 40,000 arrests in 2019 alone. Of those, 8,100 were felonies. That’s 22 felony arrests per day. Generally, anyone arrested will be offered a state-appointed attorney if they cannot afford their own.
Do you see the problem here?
Public defenders are horrifically overworked and continuously inundated with cases. Some studies suggest the average public defender has a caseload three or four times larger than they are comfortable handling.
The more cases an attorney has, the less time they have to craft a compelling defense. It’s partially why public defenders only win a fraction of their trials.
It’s a serious problem with our legal system that will require years of reform and politicking. But the accused can’t wait that long. They need someone to help them today.
Those who consult a private criminal defense attorney are more likely to secure their freedom, or at least receive a lighter penalty than those who rely on a public defender. A skilled criminal defense attorney has the time to ask their client questions, consult witnesses, and fully evaluate the evidence.
Criminal charges are a life-defining moment that, with an imprecise balancing of scales, could change your life forever. A private defense attorney can help weigh the odds in your favor and get you a just verdict.
