What Happens During the Probate Process?
If the deceased individual had a will in place, a judge will validate it, and the court will authorize the executor to conduct transactions in accordance with the will’s provisions on behalf of the estate. However, if the decedent did not have a will, the court will decide how property is distributed and will appoint an administrator to carry out the court’s orders.
The executor or administrator is responsible for handling all aspects of the probate process, including:
- Locating assets: Often, this requires quite a bit of looking around to identify and inventory the decedent’s assets.
- Determining property values: Either the court or the executor will appoint an appraiser to determine asset values at the date of death.
- Paying creditors and taxes: The executor must contact the decedent’s financial institutions and creditors to determine if they had any outstanding debts. If so, they must pay these debts using estate funds.
- Distributing property: If the decedent had a will, the executor will make distributions based on the terms of the will. Otherwise, the administrator will distribute assets based on the judge’s order.
